Warranty Terms
Limited Warranty Coverage
Each EC Product and its components are warranted against defects in material and workmanship. This warranty is provided only to the original end-user purchaser of the EC Product (“Customer”) and is not extended to any subsequent owner except as provided under Transferability below.
The warranty period is one (1) year from the date the EC Product ships from Manufacturer’s facility (“Warranty Period”), as evidenced by Manufacturer’s shipping records, bill of lading, or tracking information, regardless of the date of delivery, installation, or first use.
Manufacturer’s specified maintenance procedures must be followed and, where applicable, documented in order to maintain warranty coverage.
Because the Warranty Period runs from ship date, Customer is responsible for promptly inspecting each EC Product upon receipt and installing it without unreasonable delay. Delay in installation, first use, or discovery of a defect does not extend the Warranty Period.
Repair or Replacement Only
Manufacturer’s sole obligation, and Customer’s exclusive remedy, under this warranty is limited to repairing or replacing, at Manufacturer’s discretion, the defective EC Product or component. Manufacturer will not be responsible for the cost of labor to remove or reinstall a component, or for freight, unless otherwise agreed in writing.
Disclaimer of Warranty
THIS WARRANTY IS MANUFACTURER’S SOLE AND EXCLUSIVE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES OF WHATEVER KIND OR NATURE, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, OR OTHER WARRANTY OF QUALITY OR PERFORMANCE OR NONINFRINGEMENT. ALL SUCH OTHER WARRANTIES ARE HEREBY DISCLAIMED BY MANUFACTURER AND WAIVED BY CUSTOMER.
THIS WARRANTY DOES NOT INCLUDE ANY WARRANTY THAT AN EC PRODUCT WILL MEET ANY PERSON’S PRODUCTION OR THROUGHPUT SPECIFICATIONS, OR THAT OPERATION OF ANY EC PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.
Limits and Exclusions of Warranty
The following are excluded from this warranty:
- Components subject to normal wear, including hoses, fittings, seals, gaskets, filters, pump diaphragms, valves, and similar wear items.
- Damage or failure resulting from use of fluids, chemicals, or additives that are not compatible with the EC Product’s specified seal and wetted-component materials (e.g., use of a fluid incompatible with equipment-specific seals, as applicable to the specific machine).
- Damage resulting from mishandling, misuse, abuse, neglect, accident, improper installation, improper maintenance or storage, or improper operation or application.
- EC Products that have been repaired or serviced by anyone other than Manufacturer or an authorized service provider.
- EC Products that have been modified without Manufacturer’s prior written authorization.
- Damage due to external causes beyond Manufacturer’s reasonable control, including theft, vandalism, fire, flood, or other weather event.
Limitation of Liability and Damages
MANUFACTURER WILL NOT BE LIABLE TO CUSTOMER OR ANY OTHER PERSON FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ANY EC PRODUCT, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, COST OF DOWN TIME, OR DAMAGE TO OTHER PROPERTY, EVEN IF MANUFACTURER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MANUFACTURER’S SOLE LIABILITY, AND CUSTOMER’S EXCLUSIVE REMEDY, FOR ANY CLAIM ARISING FROM AN EC PRODUCT SHALL BE LIMITED TO REPAIR OR REPLACEMENT AS PROVIDED IN THIS WARRANTY.
Customer acknowledges that the price of EC Products reflects, and is made possible by, this allocation of risk.
Warranty Claims Procedure
To make a warranty claim, Customer must submit a claim at engineclean.com/warranty-claim and provide the EC Product model, serial number, invoice or ship date, and a description of the defect. Manufacturer may request photos, videos, or return of the defective part or product before issuing a Return Material Authorization (RMA). Parts or products returned without a valid RMA number may be refused.
Transferability
This warranty may be transferred from the original Customer to a subsequent owner if the EC Product is sold via private sale before the Warranty Period ends, provided Manufacturer receives written notice of the transfer and the warranty is not void at the time of transfer. The transferee is subject to all terms of this Certificate.
Entire Agreement
This Certificate is Manufacturer’s complete and exclusive statement of warranty terms for EC Products and supersedes any prior or contemporaneous oral or written representations on the subject. No term of this Certificate may be modified except by a written agreement signed by Manufacturer.
Governing Law and Venue
This warranty is governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising from this warranty shall be resolved in a court of competent jurisdiction in Los Angeles County, California.
If any provision of this Certificate is held invalid or unenforceable in any jurisdiction, the remaining provisions remain in full force and effect.
